I Chapter
1) This statute specifies principles of usage of the Service available under Internet address http://bigbase.com, which is property of Big-Base.com Tadeusz Kolczok Company. This statute is – apart from Civil Code regulations and other legal acts regarding services provided by means of electronic way – the only one legal basis in case of a dispute being subject of legal proceedings.
2) The terms used herein shall have the following meaning:
a) Service - is a list of companies from the world and offered by them goods and services. The list of companies was made available in form of products and services browser under the address http://bigbase.com
b) Big-Base.com - Big-Base.com Tadeusz Kolczok with its registered office in Tarnowskie Góry at ul. Batalionów Chłopskich 2 NIP 626-067-05-22 – owner of the Directory.
c) Moderator - Directory manager
d) User - a natural or legal person using the Directory.
e) Client - each natural person, legal person, an organisational entity without legal personality as well as an advertising agency or another agent, booking or instructing to make an Entry, Advertisement or another service specified in the Directory’s offer, on its own behalf or on behalf of its clients
f) Entry - presentation of Client’s company, service or product placed on the Directory site.
g) Client’s Panel - a part of the Directory available to Clients after logging in to the directory at site http://bigbase.com/management.php, where clients may make changes to their Entry and other operations associated with Entry and Advertisement.
h) Advertisement - other, different than Entry forms of company’s presentation as well as service of product presentation occurring on Service websites, based on separate agreement made between Big–Base.com Company and a Customer or User. Provisions of chapter 2 are not applicable in such a case.
i) Registration Form - form to be found at site http://bigbase.com/addcompany.php
j) List of Companies - list of Entries meeting the criteria specified in the browser form by the User.
k) Price List - price list to be found at address http://bigbase.com/prices.php
3) The expressions Directory and Moderator may be used interchangeably and refer to the Directory manager.
II Chapter
1) Entry occurs in the service due to filling in a Registration Form. Filling in the Form and sending it to a Moderator means giving consent to process personal data according to Resolution dated on August 29th 1997 regarding personal data protection (Dz.U dated on 2002 No. 101 point 926 and further amendments).
2) An Entry is paid for, according to prices included in a Price list or one the basis of individual agreements made with Moderator.
3) Moderator activates an Entry after reception of payment for period it is supposed to be valid (paid for). Reception of cash – and the fact of the service commence – are communicated (confirmed) by sending an email to a Customer. Simultaneously there shall be issued a VAT invoice which is sent to Customer into his/her correspondence address.
4) The Client authorises Big-Base.com to issue the VAT invoice without the recipient’s signature.
5) Payments are to be made to the bank account of Big-Base.com.
6) Within 180 days from activation date of an Entry, Customer is entitled to give up the Entry and apply for borne expenses return. In such a case there is issued within 7 working days from notification given in paper form by the Customer regarding his/her resignation (by mail or into e-mail address office@bigbase.com) a VAT correction invoice and Customer is obligated to sign it and re-send it by normal or registered letter into Big-Base.com Company’s address. After reception of signed by the Customer Correction Invoice there is made the return into indicated by the Customer bank account.
7) Agreement on Entry presentation terminates after period it was paid to be valid for. Extension of the agreement is made if another period is paid for. The fact of agreement termination and its extension shall be communicated by means of electronic mail, into Customer’s email address.
8) Payments (extending an Entry) should be made - at the latest - on date of previous period termination. In case until this date payment is not made presentation of the Entry shall be suspended.
9) All remarks and complaints must be addressed to the Moderator by phone or email. Made complaint shall be decided within 30 days from moment of its reception. Moderator, by phone or email shall inform about effect of made complaint.

III Chapter
1) The Client agrees to have his personal data transferred for the purposes of the Directory,
2) The Client agrees to receive bulletins, advertising materials, promotional offers, advertising messages, etc., distributed by the Directory, at his e-mail address
3) All rights to the Directory are held by Big-Base.com. Copying of any parts or in entirety, use of graphic elements without written consent of the Directory is prohibited.
4) The Directory is available 24/7 throughout the year. However the Directory reserves the right to restrict availability due to emergency situations or maintenance. In no instance will the Directory be liable for any losses due to such restricted availability.
5) The data acquired from the Directory may be used solely for private purposes by Users or Clients, i.e. the data may not be used for purposes related to (any) business operations or with respect to public information operations unless based on a separate contract with the Directory or an order confirmed with an invoice.
6) It is prohibited to use the information obtained from the Directory to provide any serial correspondence, irrespective of nature and content thereof.
7) It is prohibited to disclose information obtained from the Directory to any third parties, free of charge or for a fee, or public presentation or distribution of such information. Users may make printouts solely for their own purposes.
8) Access to databases without any software other than regular Internet browsers is a breach of the provisions hereof and may prove to be a breach of the law.
9) Should a User of Customer violate this statute or Big-Base.com can suppose that a User of Customer violate or intend to violate these terms and conditions – especially – using a product or its party to run commercial activity, support running a freelancer activity or any commercial or public activity, the Company reserves its rights to deny access for such a User or Customer to the Service. Moreover, the Service, in such a case is entitled to require compensation related to violation of intellectual possession rights or third parties’ rights. Should a violation be made by a Customer he/she is not entitled to payment return.
10) The Directory is taking all measures to provide User with top quality service. However, the Directory shall not be held liable for any loses or lost benefits to Users related to using the Directory, resulting from incorrect information in the data base or incorrect functioning of the Internet.
11) The Directory reserves the right to introduce individual access restrictions to the directory for some Users without specifying a reason for doing so.
12) Presence of Customer’s email address in database doesn’t mean Customer’s consent given to receive any unordered mails and, with regard to this fact, a User is subject of criminal responsibility assumed in art. 24 of Resolution dated on July 18th 2002 regarding services provided by electronic way (Dz. U. no. 144, item 1204 and further amendments).
13) The Directory is not liable for quality of Clients’ data.
14) The Service is not liable for any damaged made by a Customer to third parties with regard to his/ her Entry in the Service.
15) Illegal texts are prohibited.
16) Should quoted provisions included in this statute be changed or cancelled, they are replaced by new ones without a need of this statute replacement.
17) In cases not regulated in this statute Civil Code regulations are applicable as well as provisions of resolution dated on July 18th 2002 regarding services provided by electronic way (Dz. U. no. 144, point 1204 and further amendments), resolution dated on August 29th 1997 regarding personal data protection or other legal regulation regarding services provided by electronic (Dz.U dated on 2002 no. 101 point 926 and further amendments).
